Sales general conditions

When you buy an article you will accept the following:

1. you are responsible for reading the complete item / product / service listing before committing to buy it:

2. you undertake to enter into a legally binding contract for the purchase of an item / product / service when you commit to purchase and complete the check-out payment procedure.

The prices we charge for using our products are listed on the website. We reserve the right to change our prices for the displayed products at any time and to correct pricing errors that may inadvertently occur.

Services fees and any other expenses you may incur in connection with the use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your payment method.

Returns and refunds

For any intact product, simply return it with the accessories and packaging included with the original receipt (or gift receipt) within 14 days from the date of receipt of the product. We will either replace it with another item or offer a refund based on the original payment method. Please note the following: products can only be returned in the country where they were originally purchased.

Liability for Products

When we receive appeals for a product purchased from us, we will either repair the relevant defect or replace the product. If we are unable to repair or replace the product within a reasonable time, the customer will be entitled to a full refund upon returning the item. We will pay for the  delivery of repaired or replaced products to customers, whereas the latter will be responsible for the return  of the merchandise. 

Intellectual property rights, copyrights and logos

The Service and all the materials contained or transferred therein, including but not limited to software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, video, music and all relative intellectual property Rights are the exclusive property of Daniele Montariello. Except as expressly stated herein, nothing in these Terms will be deemed to be a license in or under such Intellectual Property Rights and the user agrees not to sell, license, rent, modify, distribute, copy, reproduce, broadcast, publicly display, publicly perform, publish, adapt, modify or create derivative works.

Right to suspend or cancel your account

We may permanently or temporarily terminate or suspend access to the service without notice and liability for any reason, including if, in our sole decision, you violate any provision of these Terms or any applicable law or regulation. You may be asked to stop using the service / site and may also be requested to cancel your account and / or services at any time. Notwithstanding anything to the contrary above, in relation to automatically renewed subscriptions and paid services, such subscriptions will only be suspended upon expiry of the respective period for which payment has already been made.

Liability Limitations

To the fullest extent permitted by the applicable law, Daniele Montariello can under no circumstances be held liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data or other intangible losses arising from or relating to the use or inability to use the service. To the maximum extent permitted by the applicable law, Daniele Montariello assumes no responsibility for (i) errors, errors or inaccuracies in the content; (ii) personal injury or property damage, of any nature, resulting from accessing or using our service; and (iii) any unauthorized access or use of our secure servers and / or any personal information stored therein.

Right to Change Term

We reserve the right to change these terms from time to time at our sole discretion. Therefore, it is necessary to periodically review these pages. When we substantially change the Terms, we will notify you that important changes that have been made to the Terms. If you go on using the website or our service after such changes you will accept the new Terms. If you do not agree to the terms or future versions of them, do not use or access (or continue accessing) the website or service.

Email and promotional content

You agree to receive messages and promotional materials from us from time to time, by post, email or any other way of contact  you may provide to us (including your phone number for calls or text messages). If you do not wish to receive such promotional materials or notices, please let us know at at any time.

Preference of law and dispute resolution

These Conditions, the rights and remedies provided below, and all claims and disputes relating to this and / or the services, are governed by, interpreted and enforced for all purposes exclusively in accordance with the Italian internal substantive laws, without respecting its principles on law conflicts. Any and all of these claims and disputes will be made present and you hereby consent to their exclusive decision by a court of competent jurisdiction located in Grosseto. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
